Please read these Terms of Service carefully. These Terms govern your access to and use of luxusrg.com and any webpages, property search tools, forms, and services made available through that domain (collectively, the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Agreement and Business Information

These Terms constitute an agreement between you and LUXUS Group (“LUXUS Group,” “we,” “us,” or “our”).

Andrea Gomez is a licensed Texas real estate sales agent affiliated with SERHANT Texas, a licensed Texas real estate brokerage. References to SERHANT Texas apply only where relevant to brokerage services, supervision, compliance, or a written representation agreement.

2. Real Estate Services

2.1 No Agency Relationship Through Website Use

Using the Website, submitting a form, communicating with us, creating an account, or viewing property information does not by itself create a real estate brokerage, fiduciary, representation, or agency relationship. Any representation relationship must be established through a separate written agreement signed by the applicable parties.

2.2 No Legal, Tax, Lending, or Investment Advice

Website content is provided for general informational purposes and does not constitute legal, tax, accounting, lending, engineering, inspection, insurance, or investment advice. You should consult appropriately qualified professionals before making decisions.

2.3 Texas Disclosures

Required Texas Real Estate Commission disclosures, including the Information About Brokerage Services form and Consumer Protection Notice, should be made available through links on the Website. You are encouraged to review them before engaging real estate services.

3. Property Listings and MLS Information

3.1 IDX and MLS Disclaimer

The Website may display property listings through Internet Data Exchange services, including services provided by CT IDX Pro+ and RealtyWatch Solutions. Listing information may originate from the Houston Association of REALTORS® Multiple Listing Service or other participating MLS systems. Information is deemed reliable but is not guaranteed. Properties may be subject to prior sale, lease, change, correction, or withdrawal without notice.

3.2 Independent Verification

You are responsible for independently verifying all material information, including availability, price, measurements, square footage, lot size, room dimensions, property condition, permits, schools, boundaries, taxes, assessments, HOA information, insurance, flood risk, environmental conditions, restrictions, market statistics, and transaction costs.

3.3 Permitted Use of Listing Data

Listing data is provided solely for consumers’ personal, noncommercial use in identifying properties in which they may have a genuine interest. You may not reproduce, redistribute, scrape, resell, or commercially exploit listing data except as expressly permitted by law and the applicable data provider.

4. User Accounts

If the Website permits account creation, you agree to provide accurate information, maintain the confidentiality of your credentials, promptly update changed information, accept responsibility for activity under your account, and notify us of suspected unauthorized access. We may suspend or terminate an account for misuse, security concerns, legal requirements, or violation of these Terms. You may request account deletion by contacting [email protected], subject to lawful retention obligations.

5. Acceptable Use

You may not use the Website to:

Violate applicable law, regulation, court order, or the rights of another person.

Misrepresent your identity, affiliation, authority, or intent.

Collect personal information about other users without authorization.

Use bots, scrapers, spiders, or other automated means to access, copy, monitor, or extract Website content without written authorization.

6. Communications and Consent

6.1 Inquiry and Email Communications

When you submit an inquiry, you authorize us to send communications reasonably necessary to respond to that inquiry and provide requested information. Promotional emails will be sent only as permitted by applicable law. You may unsubscribe through the link in a promotional email or by contacting [email protected].

6.2 Text Message Consent

When you affirmatively opt in through a Website form or another documented consent method, you authorize LUXUS Group to send text messages to the mobile number you provided for real estate-related purposes, including requested property information, responses to inquiries, property alerts, appointment confirmations, reminders, scheduling updates, transaction updates, and relevant market information.

Consent is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. You may also contact [email protected] or 832-722-9772. Wireless carriers are not liable for delayed or undelivered messages.

After you send STOP, you may receive one final text confirming that you have been unsubscribed. You will receive no further SMS messages unless you opt in again. If you want to rejoin, complete a new opt-in request or otherwise provide renewed consent.

Mobile phone numbers, SMS opt-in consent, and SMS consent records will not be sold or shared with third parties or affiliates for marketing or promotional purposes.

6.3 Telephone Calls

If you request telephone contact or otherwise provide legally valid consent, we may call you regarding your real estate inquiry or requested services. Calls using automated technology, prerecorded messages, or artificial voice technology will be made only with the consent required by applicable law. You may revoke consent through any reasonable method that clearly communicates your request.

7. AI Chat Assistant

The Website may use an AI-assisted chat tool. AI-generated responses are general information only, may be inaccurate or incomplete, and are not a substitute for advice from a qualified real estate or other professional. The chat tool cannot create an agency relationship or binding agreement. Conversations may be stored or reviewed for service delivery, security, and quality assurance as described in our Privacy Policy. Do not submit sensitive financial, government identification, account credential, or other confidential information through the chat unless specifically requested through a secure channel.

8. Intellectual Property

Unless otherwise stated, the Website and its original content, design, graphics, logos, text, photographs, and software are owned by or licensed to LUXUS Group, SERHANT Texas, or applicable content providers and are protected by intellectual property laws. REALTOR® and related marks are owned by the National Association of REALTORS®. SERHANT® is owned by its applicable trademark owner. MLS and listing content may be owned by applicable MLS organizations, brokers, or licensors.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for personal, lawful, noncommercial purposes. No other rights are granted.

9. User Submissions

You represent that information or content you submit is accurate to the best of your knowledge, that you have the right to submit it, and that its submission does not violate law or another person’s rights. You grant us permission to use submitted information as reasonably necessary to respond to you, provide requested services, administer transactions, operate the Website, and comply with law, subject to our Privacy Policy.

10. Third Party Links and Services

The Website may link to or integrate with third party services, including MLS providers, lenders, title companies, inspectors, social media services, government sites, mapping services, and other vendors. We do not control and are not responsible for third party content, availability, terms, security, or privacy practices. A link or integration does not necessarily constitute endorsement.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES CONCERNING ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXUS GROUP AND ITS OWNERS, PERSONNEL, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR RELIANCE ON WEBSITE CONTENT, ARISING FROM OR RELATED TO THE WEBSITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF LUXUS GROUP ARISING FROM OR RELATED TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless LUXUS Group and its owners, personnel, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Website, material violation of these Terms, or infringement of another person’s rights. This obligation does not apply to the extent a claim results from conduct for which indemnification cannot lawfully be required.

14. Suspension and Termination

We may restrict, suspend, or terminate access to all or part of the Website when reasonably necessary to address misuse, security risk, legal obligations, service discontinuation, or violations of these Terms. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, liability limitations, indemnification, and dispute provisions.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles, except where federal law controls.

15.2 Informal Resolution and Mediation

Before filing a lawsuit, you and LUXUS Group agree to make a good faith effort to resolve the dispute informally. Send a written description of the dispute to [email protected]. If the dispute is not resolved, the parties agree to attempt nonbinding mediation in Harris County, Texas, unless prohibited by applicable law.

15.3 Venue

If a dispute is not resolved informally or through mediation, any permitted lawsuit must be brought in a state or federal court located in Harris County, Texas, and each party consents to that court’s jurisdiction, except where applicable law requires otherwise.

15.4 Class Action Waiver

To the extent permitted by law, disputes will be resolved only on an individual basis and not as part of a class, consolidated, collective, or representative action. If this waiver is unenforceable for a particular claim, it will not apply to that claim.

16. Changes to These Terms

We may update these Terms by posting the revised version on the Website and changing the “Last Updated” date. When required by law, we will provide additional notice. Changes apply prospectively from their effective date. Your continued use of the Website after the effective date constitutes acceptance to the extent permitted by law.

17. General Provisions

If any provision is found invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a business transfer or by operation of law. These Terms, together with the Privacy Policy and other notices expressly incorporated by reference, constitute the agreement governing Website use. A separate signed real estate representation or transaction agreement controls if it conflicts with these Website Terms regarding the subject of that agreement.
